1. Parties.

1A.  "Rescuer" is Lab Rescue of North Carolina, Inc., by and through its agent, Kristin Major.

1B.  "Foster Home" is the person or persons below.

1C.  Foster Home has arranged with Rescuer to foster the Dog ("Dog"). This agreement shall remain in force and in effect between the Foster Home and Rescuer for each and every Dog that Foster Home agrees to foster for Rescuer.

 

2. Definitions.

2A.  Fostering shall mean caring for the Dog in the Foster Home's home until Rescuer can find a suitable permanent home. Dog remains property of Rescuer at all times during the fostering.

2B.  Approved Veterinarian shall mean a veterinarian with whom Rescuer, through its officers, has established a relationship.

 

3. Foster Home's Rights & Obligations.

3A.  Indoor Shelter. Foster Home agrees to provide a safe, indoor environment for the Dog. Foster Home understands that Dog may not be house-trained or even accustomed to living indoors. Foster Home agrees to make a good-faith effort to assist with house-training.

3B.  Health and Welfare. Foster Home agrees to feed, water, and otherwise care for Dog (Rescuer will reimburse for food if receipts are submitted), to monitor the health of Dog, including transport to an Approved Veterinarian when necessary, and to administer any necessary veterinary medicines. Foster Home shall not bear any financial responsibility for veterinary care by an Approved Veterinarian and will be provided any necessary medication from Rescuer through one of its Approved Veterinarians,

1. Heartworm Preventive. Foster Home agrees to give Dog heartworm preventive and flea/tick treatment monthly; Foster Home agrees to keep records of when such medication is administered.

3C.  Weekly Updates via E-Mail. Foster Home agrees to provide a weekly status report via e-mail correspondence to adoption@labrescuenc.org. Such status reports will aid significantly in the placement of Dog in a permanent home by Rescuer's other volunteers. Basic information about Dog's health and personality is all that is required; approximately one paragraph per week should suffice. However, Foster Home agrees to contact Rescuer immediately in the event of any medical emergency, loss or theft of Dog, or any signs of aggression (growl, snarl, snap, or bite) toward any human or other animal. Foster Home will e-mail foster@labrescuenc.org and contact an officer of Rescuer by telephone.

3D.  Contact with Potential Adoptive Homes. Foster Home agrees that upon approval of an application for adoption by Rescuer's applicant screeners, Foster Home's e-mail address and telephone number shall be provided that applicant. Rescuer will not provide any applicant the Foster Home's physical address. Foster Home agrees to discuss the dog with any approved applicant. Foster Home is encouraged to assist Rescuer in finding a good match.

1.  Application Required on All Adoptions. Rescuer must receive a completed application and approve of such application before Dog can be placed in any home.

3E.  Period of Fostering. Foster Home agrees to foster Dog until a suitable permanent home can be found or until Rescuer chooses a different Foster Home for Dog. Foster Home understands that Rescuer has high standards for permanent homes and that the fostering period could range from one week to several months. Rescuer agrees to make a good-faith effort to find a suitable match as quickly as possible.

3F.  Emergency Medical Care. Should an emergency arise, Foster Home agrees to obtain medical care for Dog. Rescuer shall reimburse Foster Home for justified emergent care. Foster Home agrees to make a good-faith effort to obtain such care from an Approved Veterinarian if possible.

 

4.  Rescuer's Rights and Obligations.

4A.  Property Rights. Rescuer retains all property rights over Dog. Rescuer may re-take possession of Dog at its choosing, including but not limited to, any of the reason provided below:

1. The Foster Home is not an appropriate match, in Rescuer's sole judgment, for Dog

2. Foster Home fails to comply with the provisions of this agreement;

3. Foster Home at any time misrepresents to the Rescuer matters which are material to the welfare of the Dog.

4. Dog exhibits any kind of aggression towards humans or other animals.

4B.  Veterinary Care. Rescuer agrees to provide Dog all necessary veterinary care through its Approved Veterinarians at its sole expense.

4C.  Food. Rescuer agrees to reimburse Foster Home for Dog's food if receipts are submitted to verify such expense. Foster Home may request Rescuer provide other supplies, just as leashes, crates, etc. Such requests will be reviewed in a timely fashion by Rescuer.

 

5.  Disclaimer of Warranty.  

AS A COURTESY TO FOSTER HOME, RESCUER HAS FURNISHED FOSTER HOME WITH LIMITED INFORMATION ABOUT DOG. RESCUER HAS NO REASON TO BELIEVE THIS INFORMATION IS FALSE; HOWEVER, RESCUER CANNOT AND DOES NOT REPRESENT THAT SUCH INFORMATION IS ACCURATE. FOSTER HOME MAY NOT AND IS NOT RELYING UPON THE ACCURACY OF INFORMATION SUPPLIED BY RESCUER IN ENTERING INTO THIS AGREEMENT. INSTEAD, FOSTER HOME HAS FULLY AND FREELY EXAMINED DOG AND BASES THE DECISION TO FOSTER DOG UPON THEIR OWN EVALUATION OF DOG'S CHARACTER, DEMEANOR, HEALTH AND CONDITION. DOG IS BEING FOSTERED BY FOSTER HOME AS IS, WITH ALL FAULTS, AND WITHOUT REPRESENTATION, GUARANTEE OR WARRANTY CONCERNING ITS PERFORMANCE OR CONDITION. FOSTER HOME HEREBY EXPRESSLY DISCLAIMS ANY WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF DOG UNDER THE UNIFORM COMMERCIAL CODE OR OTHERWISE.

 

6.  Release.  

In consideration of the Rescuer's physical transfer of Dog to Foster Home for foster care, Foster Home hereby releases and forever discharges the Rescuer from any and all loss, liability, actions, causes of actions, suits, claims, demands, damages or causes of any kind or nature whatsoever, whether presently existing or arising in the future, whether known or unknown, which arise out of or are based upon any fact, matter, claim or thing arising out of this Agreement, the adoption addressed in it, or Dog. The Foster Home acknowledges Dog is unpredictable and agrees to take all necessary precautions for the safety of Foster Home, the Foster Home's family members and/or household, and Dog.

 

7.  Entire Agreement.

This agreement contains the entire understanding of the parties with respect to the Dog. It supersedes all other written and oral agreements between the parties with respect to this subject matter. Foster Home has read this agreement, understands it, is mentally and otherwise fully competent to understand it and to enter into it, and enters into it based on her or his own free will and under no compulsion or undue influence. This agreement shall be governed, construed and enforced under the laws of the State of North Carolina. This agreement and all its terms and conditions shall be binding on the heirs, administrators, personal representatives and assigns of the Foster Home and the Rescuer.

 

8.  Headings.

Headings which appear in boldface type are solely for convenience of reference. Such headings are not part of this agreement and shall not be used to construe it.

 

9.  Identification of Dog.  

Foster Home will submit electronic identification form for each Dog fostered for Rescuer within 24 hours of Dog coming into Foster Home. Identification form should be filled out online at https://labrescuenc.org/dogid/html.

 

10.  Notification.  

The parties may be notified in writing for purposes of this agreement, by e-mail at the following addresses, and may be contacted at the following telephone or fax numbers and e-mail addresses. Foster Home shall notify Rescuer in the event of change of physical address, telephone number, and/or email address within a reasonable time after the change.
